Terms of Service

Please read these terms carefully before using Examworthy. By creating an account or accessing any part of the service you agree to be bound by them.

1. Acceptance of terms

These Terms of Service ("Terms") are a legal agreement between you and Solaisoft Pty Ltd (trading as Examworthy) [CONFIRM: legal entity + ABN], a company incorporated in Western Australia, Australia ("Examworthy", "we", "us", or "our"). By accessing or using examworthy.com or any related application ("Service") you confirm that you have read, understood, and agree to these Terms. If you do not agree, you must stop using the Service immediately.

2. Description of service

Examworthy is an online certification exam-preparation platform. It provides original, blueprint-aligned practice questions, per-domain readiness scoring, flashcards, cheat sheets, and study guides for IT and security certifications. The Service is provided on a subscription or one-time purchase basis as described on the pricing page.

We reserve the right to modify, suspend, or discontinue any part of the Service at any time with reasonable notice where practicable. We will not be liable to you or any third party for any modification, suspension, or discontinuation.

3. Accounts and acceptable use

You must be at least 16 years old to register. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Notify us immediately at support@examworthy.com if you suspect unauthorised access.

You agree not to:

  • Share your account credentials or allow others to access the Service through your account.
  • Copy, scrape, reproduce, or redistribute any questions, explanations, or other content from the Service by any means.
  • Use the Service to prepare or distribute brain dumps, exam memorisation products, or any material that violates a certification body's candidate agreement.
  • Attempt to reverse-engineer, decompile, or extract the question bank or any proprietary content.
  • Use the Service in any way that is unlawful, fraudulent, or harmful to Examworthy or other users.

4. Intellectual property

All content on the Service - including but not limited to practice questions, answer rationales, cheat sheets, study guides, domain weightings, and software - is owned by or licensed to Examworthy and is protected by copyright and other intellectual property laws. You may use the content solely for your own personal, non-commercial exam study. No other use is permitted without our prior written consent.

Examworthy writes all of its own questions. We never reproduce, paraphrase, or brain-dump live or retired exam items from any certification vendor. All questions are original practice material aligned to publicly available exam blueprints and objectives.

Certification names, logos, and related trademarks (including but not limited to CompTIA Security+, CISSP, AWS, and CISM) are the property of their respective owners. Examworthy is not affiliated with, endorsed by, or officially connected to any certification body or vendor. Use of these names on the Service is for descriptive purposes only.

5. Subscriptions and billing

Paid access is offered as recurring subscriptions or one-time purchases. All prices are listed on the pricing page and are inclusive of any applicable taxes where required by law.

  • Auto-renewal. Subscriptions renew automatically at the end of each billing period unless you cancel before the renewal date. You authorise us to charge your payment method on file for each renewal.
  • Cancellation. You may cancel your subscription at any time from your account settings. Cancellation takes effect at the end of the current paid period; you retain access until then. We do not prorate partial periods.
  • Payment processing. Payments are processed by Stripe. Examworthy never stores your card number or full payment details. By completing a purchase you also agree to Stripe's terms of service.
  • Refunds. Refunds are governed by our Refund and Cancellation Policy, which forms part of these Terms.

6. Disclaimers

The Service is provided "as is" and "as available". Examworthy makes no warranty, express or implied, that the Service will be uninterrupted, error-free, or free of harmful components.

No guarantee of passing. Practice questions and readiness scores are indicators to help you gauge preparedness. They are not a guarantee that you will pass any certification exam. Exam content is controlled entirely by the relevant certification body, and passing depends on many factors outside our control.

7. Limitation of liability

To the maximum extent permitted by law, Examworthy and its officers, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the Service, including but not limited to loss of profits, data, or business opportunities, even if we have been advised of the possibility of such damages.

Our total aggregate liability to you for any claim arising out of or relating to these Terms or the Service will not exceed the amount you paid to Examworthy in the twelve months preceding the claim.

8. Australian Consumer Law

Nothing in these Terms excludes, restricts, or modifies any consumer guarantee, right, or remedy conferred by the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010 (Cth)) or any other applicable consumer protection legislation that cannot lawfully be excluded or modified. Where Examworthy is in breach of a consumer guarantee that cannot be excluded, our liability is limited, to the extent permitted by law, to re-supplying the relevant services or paying the cost of having them re-supplied.

9. Changes to these terms

We may update these Terms from time to time. We will notify you of material changes by email or by a notice on the Service at least 14 days before the changes take effect. Continued use of the Service after that date constitutes acceptance of the updated Terms. If you do not agree with the changes, you may close your account before they take effect.

10. Governing law

These Terms are governed by the laws of Western Australia, Australia. Any dispute arising out of or relating to these Terms or the Service will be subject to the exclusive jurisdiction of the courts of Western Australia, except where applicable consumer law requires otherwise.
